Article 1. Terms of Service

Thank you for using AmraXismet web services. These terms of service ("Agreement") govern your use of and access to AmraXismet's services, client software, and websites ("Services"). (For clarity, "Services" include the "Broadcast Services" as defined below).

By using our Services, you agree to be bound by the terms of this Agreement and to review our Privacy Policy and Acceptable Use and Fair Usage Policy. If you are using our Services on behalf of an organization, you agree to the terms of this Agreement on behalf of that organization.

By accessing or using the Service, you agree to all the terms and conditions stated in this Agreement. If you do not agree with the terms of this Agreement at any time, you must stop accessing or using the Service.
 

Article 2. Service Authorisations of your Assets and your permissions

When you use our Services, you provide us with things like your files, content, configuration settings, metadata, etc. ("Your Assets"). Your Assets remain yours. The terms of this Agreement do not give us any rights to Your Assets except for the limited rights that enable us to offer the Services.

If you want to use our Release Service for your recordings, you must carefully review all applicable provisions of this Agreement.

We need your permission to do things like hosting your assets, backing them up, and sharing them when you ask us to. Our Services also provide features like free upload to a wide network host, sharing, searching, and releasing. These and other features may require our systems to access, store, and scan your assets. We may also use your data to conduct research, testing functionality during the development phase, analyze the information we have to improve our services, implement new services and functionalities, and perform audits and troubleshooting procedures or for promotional purposes. You give us permission to do these things, and this permission extends to trusted third parties we work with.

Once you visit our Services via an offer or link provided by AmraXismet or your partner, it is likely that we share some of Your Data with said partner, specifically your name, email address, and information about your use of our Services. You authorize us to share such information with the aforementioned partner. The data shared with this partner is also governed by the terms of service and privacy policy of this partner.
 

Article 3. Service Resources and Sharing Your Assets

Our Services allow you to share your assets with others, so think carefully about what you share. You understand that you assume all risks, including unwanted public disclosure, associated with your decision to share your assets. When you share your assets, you are responsible for ensuring that those who have access understand what they may or may not do with Your Assets. Sharing your assets through our Services does not entitle you to payments from participants in our Services.
 

Article 4. Copyright Rights / Your Copyright Rights

AmraXismet uploads your track through a paid partnership. You do not pay upload costs or monthly promotion costs, but a one-time 15% royalty fee. By uploading via AmraXismet web service, you agree to the 15% royalty fee that AmraXismet deducts from your paid tracks. You retain 85% of the royalties. The amounts will be transferred to your provided contact details and/or PayPal account.

When content is shared with you, offering comments, suggestions, and/or feedback on another user's content on the AmraXismet site does not entitle you to ownership rights or credits in that content, nor does it entitle you to royalties or other monetary payments derived from that content. Without written permission from the party owning the content shared with you, you may not share or reproduce the other user's content. For more information about your rights as a contributor, songwriter, or performer, contact your performance rights organization, publisher, and/or legal advisor.
 

Article 5. Copyrights Your rights

We respect the intellectual property of others and ask that you do the same. We respond to notices of alleged copyright infringement if they comply with the law, and such notices should be emailed to us. We reserve the right to remove or disable content alleged to be infringing and to terminate accounts of repeat infringers. Our designated agent for notice of alleged copyright infringement on the Services is: AmraXismet@hotmail.com.
